WHAT IS A RESTRAINING ORDER?
Restraining orders are orders that prevent one party from coming into contact with, or causing someone to come into contact with the protected person.
These orders are made by a Magistrates Court and are enforceable by the Police when they are breached.
In Western Australia, you can apply for a restraining order, prusuant to the Restraining Orders Act 1997
(WA) if you have been, for example; threatened, harassed, abused, stalked, assaulted in any form or suffered harm due to the actions of another.
You may also be able to apply for a restraining order if you have a reasonable belief that you may be at risk of any of the above.
WHAT PROTECTION DOES A RESTRAINING ORDER GIVE ME?
Examples of conditions that may be imposed by the court include:
-
Being prevented from being on or near the premises of the protected person;
-
Being prevented from being on or near a specified location;
-
Being prevented from approaching within a specified distance of the protected person;
-
Being prevented from attempting to communicate with the protected person; and
